A California Licensed Professional Fiduciary is someone who is given the legal authority to make financial and/or healthcare decisions on behalf of an individual or a trust. Professional fiduciaries must keep their client's best interests in mind when making decisions.
Ideally naming someone to step in in the event of incapacity or death is part of the estate planning process, but sometimes even the best laid plans can go awry. Relationships change, people move away and family members can disagree about the appropriate course of action or may even be taking advantage of the situation. A California Licensed Fiduciary is a neutral third party who can step in and help individuals and families navigate changing responsibilities.
In California, Professional Fiduciaries must be licensed. As described on the Professional Fiduciary Association of California website, "California Licensed Professional Fiduciaries are licensed and regulated through the Bureau of Consumer Affairs and must follow a strict code of ethics. One must take courses required by the licensing bureau, pass a lengthy exam, attend continuing education, have a clean background check and be bondable."
